Agreement to these Terms

These Terms of Service are a binding agreement between you and DRAFTNIGHT LLC ("DRAFTNIGHT," "we," "us," or "our") governing your access to DRAFTNIGHT.tv and its related applications, features, and services (the "Service"). By accessing or using the Service, creating an account, joining a draft, or purchasing a Season Pass, you agree to these Terms and our Privacy Policy and Refund and Cancellation Policy.

If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian. Purchases may be made only by an adult or by someone with the account holder's and payment method owner's authorization.

You are responsible for accurate account information, safeguarding your credentials and draft access links, and activity occurring through your account. Notify us promptly at support@draftnight.tv if you suspect unauthorized access.

The Service

DRAFTNIGHT provides tools for configuring and presenting fantasy sports drafts, including commissioner controls, phone controllers, draft boards, media, reactions, and results. DRAFTNIGHT does not operate a fantasy league, award prizes, accept wagers, provide gambling services, or submit final rosters to third-party fantasy platforms.

You are responsible for obtaining and paying for the internet access, local network, display, mobile devices, computers, and other equipment needed to use the Service. You remain responsible for verifying draft settings, picks, results, eligibility rules, and entries on any third-party platform. Features may change as the Service evolves.

Season Passes and billing

Paid access is sold as a seasonal license for the tier and league limit shown at checkout. Unless a different date is clearly displayed before purchase, access continues through March 1 following the applicable fantasy football season. Buying later in a season does not prorate the initial price.

New Season Passes do not renew automatically by default. If you affirmatively enable renewal, you may disable it from your dashboard before the renewal date. Disabling renewal prevents the next charge and does not end access already purchased. Upgrades may be offered for the difference between tiers; downgrades are not available during the current season.

Prices, taxes, and material purchase terms are displayed at checkout. Payments are processed by Stripe. Refunds are governed by our Refund and Cancellation Policy.

Your content and uploads

You retain ownership of names, logos, images, audio, video, and other content you submit. You grant DRAFTNIGHT a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify for technical purposes, display, and transmit that content only as needed to operate, secure, and improve the Service.

You are solely responsible for your content and for deciding what to share. Content used in a draft may be visible to commissioners, participants, invited viewers, or anyone with an applicable room or results link. We do not routinely pre-screen every upload and cannot guarantee that user content will be accurate, appropriate, or secure. We may review, reject, remove, preserve, or disclose content when reasonably necessary to operate the Service, enforce these Terms, respond to valid legal process, or protect rights and safety.

You represent that you have all rights and permissions needed for your content. You may not upload content that infringes intellectual property or privacy rights; is unlawful, deceptive, hateful, harassing, sexually exploitative, malicious, or unsafe; contains malware; or violates another person's rights. We may reject, remove, or disable content that violates these Terms or creates risk for users or the Service.

Acceptable use

You may not misuse the Service or help anyone else do so. Prohibited conduct includes:

• Accessing accounts, rooms, systems, or data without authorization.
• Disrupting live drafts, evading rate limits, probing security, or introducing harmful code.
• Scraping, reselling, copying, or reverse engineering the Service except where applicable law expressly permits it.
• Using the Service for fraud, unlawful gambling, threats, harassment, impersonation, spam, or infringement.
• Collecting or attempting to collect another person's personal information without their knowledge, consent, or other lawful authority.
• Interfering with other users, abusing storage or upload limits, or placing unreasonable load on the Service.

You must communicate respectfully with other users and DRAFTNIGHT personnel. We may restrict support access or suspend an account for abusive, threatening, or persistently harassing conduct.

Third-party services, links, and data

The Service may link to, display information from, or interoperate with websites, platforms, data sources, and services that DRAFTNIGHT does not control. Your use of a third-party service is governed by that provider's terms and privacy practices. A link or integration does not mean DRAFTNIGHT endorses the third party, and we are not responsible for its availability, content, security, products, or conduct.

Player names, teams, positions, rankings, average draft position, statistics, injury information, and similar data may come from third-party sources. We work to present useful information but do not create or independently verify every data point and do not guarantee that third-party data is complete, current, accurate, uninterrupted, or error-free. Confirm critical information before relying on it for a draft.

DRAFTNIGHT intellectual property

The Service, software, designs, branding, and original content are owned by DRAFTNIGHT LLC or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal or internal league use during your authorized access period.

Third-party names and marks belong to their respective owners. DRAFTNIGHT is not affiliated with or endorsed by the National Football League, its teams, or third-party fantasy platforms.

Availability and changes

Live software depends on internet connections, hosting providers, third-party services, devices, and local networks. We work to provide a reliable experience but do not guarantee uninterrupted, error-free, or universally compatible operation. We may maintain, modify, suspend, or discontinue features and may impose reasonable capacity or security limits.

You should prepare a backup process for time-sensitive drafts. Contact support promptly if a material service failure affects a paid draft.

Feedback and suggestions

If you voluntarily send us ideas, suggestions, or other feedback about the Service, you grant DRAFTNIGHT LLC a worldwide, perpetual, irrevocable, royalty-free right to use, modify, disclose, and commercialize that feedback without restriction or compensation. This does not transfer ownership of your league content or uploaded media, and it does not apply to personal information governed by our Privacy Policy.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access when reasonably necessary to address a Terms violation, fraud, nonpayment, security risk, harm to others, legal requirement, or material threat to the Service. Where practical, we will provide notice and an opportunity to correct the issue.

Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

To the maximum extent permitted by law, DRAFTNIGHT LLC and its members, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, lost profits, or loss arising from league outcomes. Our aggregate liability arising from the Service will not exceed the greater of the amount you paid us during the 12 months before the event giving rise to the claim or $100. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless DRAFTNIGHT LLC from third-party claims and reasonable costs arising from your content, your unlawful misuse of the Service, or your material violation of these Terms or another person's rights.

Governing law and disputes

Indiana law governs these Terms without regard to conflict-of-law principles. Any dispute not resolved informally will be brought exclusively in the state or federal courts with jurisdiction in Indiana, and each party consents to those courts. Before filing a claim, please contact support@draftnight.tv so we can try to resolve it.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer law.

Changes and contact

We may update these Terms. We will post the revised version with a new effective date and provide additional notice when a change materially affects your rights. Continued use after the revised Terms take effect constitutes acceptance where permitted by law.

These Terms, together with the policies incorporated above, form the entire agreement concerning the Service. If one provision is unenforceable, the remaining provisions continue in effect. Questions may be sent to DRAFTNIGHT LLC at support@draftnight.tv.
