Overview
DRAFTNIGHT LLC respects intellectual property rights and expects DRAFTNIGHT users to do the same. This Policy explains how copyright owners may report material stored or displayed through DRAFTNIGHT.tv that they believe infringes copyright, and how affected users may respond.
This process is intended to address copyright claims under the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the “DMCA”). It is not the correct process for trademark, privacy, harassment, contract, or general content disputes. Those concerns may be sent separately to support@draftnight.tv.
Before submitting a notice
Consider whether the material is authorized by the copyright owner or permitted by law, including fair use, license, public-domain status, or another exception. A DMCA notice is a legal request. Knowingly making a material misrepresentation that content is infringing may expose the sender to liability under 17 U.S.C. § 512(f).
If you are uncertain whether you own the relevant rights or whether an exception applies, consider obtaining legal advice before submitting a notice.
Copyright infringement notice
A copyright owner or authorized agent may send a written notice containing all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
- Identification of the copyrighted work claimed to have been infringed or, if multiple works are covered, a representative list.
- Identification of the allegedly infringing material and information reasonably sufficient for us to locate it, such as the relevant DRAFTNIGHT URL, room code, league identifier, file name, team name, or screenshot. Do not send room access tokens.
- Your name, mailing address, telephone number, and email address so we can contact you.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Email notices should use the subject “DMCA notice.” DRAFTNIGHT LLC must register a designated agent with the U.S. Copyright Office and publish the agent's complete mailing address and telephone number before relying on this page as satisfying all DMCA safe-harbor designation requirements. Until those details are added, this email remains the operational contact for copyright complaints but is not a representation that every statutory safe-harbor requirement has been completed.
How we respond
When we receive a facially valid notice, we may remove or disable access to the identified material and take reasonable steps to notify the user who provided it. We may provide that user with a copy of the notice, including the claimant's contact information, as part of the statutory process.
We may request clarification, decline to act on an incomplete or facially invalid notice, preserve relevant records, or forward the notice to service providers involved in storing or delivering the material. Removal does not mean that DRAFTNIGHT LLC has decided the claim's ultimate merits.
Counter-notification
If your content was removed or disabled because of a DMCA notice and you believe that happened through mistake or misidentification, you may send a written counter-notification containing:
- Your physical or electronic signature.
- Identification of the material removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of the United States federal district court for the judicial district containing your address, or, if your address is outside the United States, a federal judicial district in which DRAFTNIGHT LLC may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.

Possible restoration
After forwarding a valid counter-notification to the original claimant, we may restore the material no sooner than 10 and no later than 14 business days after receipt of the counter-notification unless the claimant informs us that they filed a court action seeking to restrain the user from the allegedly infringing activity. We may decline restoration where another legal, safety, or Terms-of-Service reason independently supports removal.
Repeat infringers
In appropriate circumstances and at our reasonable discretion, DRAFTNIGHT LLC may suspend or terminate accounts of users who repeatedly infringe copyright or repeatedly submit content that is the subject of valid infringement notices. We may also restrict uploads or remove content when necessary to protect rights holders, users, service providers, or the Service.
Misuse and other rights
We may disregard abusive, fraudulent, duplicative, or bad-faith submissions and may take appropriate action when the DMCA process is used to harass users or suppress lawful material. DRAFTNIGHT LLC reserves all defenses, limitations, and rights available under law.
Nothing in this Policy constitutes legal advice, an admission of liability, or a waiver of any right or defense. The DMCA process does not determine ownership or conclusively resolve an infringement dispute; courts make those determinations.
Policy changes
We may update this Policy to reflect changes to the Service, our designated-agent information, or applicable law. The current version and effective date will be posted on this page.
